The following terms and conditions will apply between you and Nigel Ingram Paintings for the purchase of any item. These terms do not affect your statutory rights.

Acceptance of Terms and Conditions

By ordering a product from Nigel Ingram Paintings you accept these terms and conditions. These terms and conditions are subject to change at any time.

Orders

The products, descriptions, and prices shown on this website constitute an “invitation to treat”, consequently all orders are subject to acceptance and product availability.

Orders placed through this website, whether payment is made at the time of order or not, are subject to confirmation of acceptance by Nigel Ingram Paintings. Up to the point of acceptance orders placed through the online ordering facility should not be interpreted as contractually binding on either party. Automated system acknowledgements of receipt of the order, confirmation of order, or receipt of payment, do not constitute acceptance of the order by Nigel Ingram Paintings. Dispatch of your order at the prices shown on the website will in all cases constitute formal acceptance of the order by Nigel Ingram Paintings in the absence of any other formal acceptance.

Our Contract

A legally binding contract between you and Nigel Ingram Paintings will be formed when your order is dispatched. If your order is only partially dispatched, the contract will only apply to the goods dispatched. The products that have not been dispatched will not form part of this contract with you until they are dispatched.

Although Nigel Ingram Paintings endeavour to ensure prices on this website are correct, Nigel Ingram Paintings reserve the right to change prices without prior notice. In the event of any change e.g. in price or expected delivery date between completion of your order and dispatch, Nigel Ingram Paintings shall inform you by e-mail and you shall at that point have the right to either (a) accept the change, in which case your reply will represent a new offer which Nigel Ingram Paintings will accept upon dispatch, or (b) reject the change, in which case your reply will represent a withdrawal of your order, or the remaining part of your order.

Product Substitution

In the event of a product becoming unavailable, no alternative product will be substituted by Nigel Ingram Paintings without your prior agreement. Nigel Ingram Paintings shall inform you by e-mail of any suitable substitute product and you shall at that point have the right to either (a) accept the substitution, in which case your reply will represent a new offer which Nigel Ingram Paintings will accept upon dispatch, or (b) reject the change, in which case your reply will represent a withdrawal of your order, or the remaining part of your order.

Delivery Times and Charges

Orders are usually dispatched within 7 to 14 days of receipt of order.  If Nigel Ingram Paintings do not have the item you have ordered in stock you will be advised of the estimated delivery time.

Orders for delivery in the UK are CARRIAGE FREE, and will be shipped by the most appropriate method selected by Nigel Ingram Paintings. Express delivery may be arranged by quotation.

VAT

Nigel Ingram Paintings is not registered for VAT, and VAT is not charged on sales.

Payment

Nigel Ingram Paintings accept debit or credit cards and cheques made payable to Nigel Ingram.

Payment may be made through this website, by post, or over the telephone.

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Nigel Ingram Paintings, your order will not be accepted and Nigel Ingram Paintings will not be liable for any delay or non-delivery.

Orders paid for by cheque will not be dispatched until Nigel Ingram Paintings receive confirmation of cheque clearance.

Returns Policy

This returns policy does not affect your statutory right to cancel but is separate and additional to your statutory right.

Notice of Your Statutory Right to Cancel

You have the right to cancel the purchase of any item from the time it is ordered to within seven working days of delivery (starting the day after you receive the goods). This is a UK statutory right.

Should you exercise your statutory right to cancel the contract Nigel Ingram Paintings will refund the price you have paid for the goods and standard delivery, but not an additional service provided by Nigel Ingram Paintings, such as special packing or a special delivery service.

You are under a duty to take reasonable care of the goods, which means you are responsible for maintaining the goods in the same condition in which they were received. If the item is not in the same condition as delivered, this may affect your statutory right to cancel.

How to cancel

To cancel an order, please send a request to cancel the order in writing, by either e-mail or post, stating the reasons for your cancellation of the order or return.

Please note that you will be responsible for the costs of returning the goods to us unless Nigel Ingram Paintings delivered the item to you in error, or the item is faulty.  If Nigel Ingram Paintings do not receive the goods back from you, Nigel Ingram Paintings may arrange for collection of the item from you and charge the cost of collection to you.

After cancellation of the order, Nigel Ingram Paintings will refund the relevant part of the purchase price for that item to you as soon as possible after the return of the goods, and within a maximum period of 30 days from cancellation.

Refunds will be made by the same method of payment as the original payment. Nigel Ingram Paintings will not be responsible for any delays arising through the banking system in the crediting of refunds to cardholder accounts. 

Warranty

Should there be a fault with the product Nigel Ingram Paintings will replace it free of charge and refund the postage you incurred up to a maximum of £10.00. Wear and tear is not covered under this warranty.

Force majeure

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control.

Your undertakings and warranties

You warrant that the information given on your order form is complete and accurate.

Limitation of Liability

Although Nigel Ingram Paintings take every care to ensure accuracy, Nigel Ingram Paintings make no warranties as to the accuracy of the information on the web site. The extent of the liability of Nigel Ingram Paintings for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction.

Copyright in all art, pictures, products, content, designs, text, and images in whatever form supplied by Nigel Ingram Paintings remains the property of Nigel Ingram at all times. No painting, print, image or product supplied by Nigel Ingram Paintings or reproduced on this website may be copied or reproduced in any way without the express written permission of the copyright owner.

Copyright is not transferred on the purchase of any piece of art, print, image, or product of any form, and purchase does not imply a right to reproduce an image without appropriate permission.

Invalidity of Terms and Condition

If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.

Governing Law and Jurisdiction

Contracts between you and Nigel Ingram Paintings shall be governed by English Law and you and Nigel Ingram Paintings submit to the exclusive jurisdiction of the English courts.
